What Mediation Is

Mediation is a confidential, voluntary process in which a neutral mediator helps the parties reach their own agreement. The mediator does not decide who is right, does not take sides, and does not give either party legal advice. The role is to keep the discussion productive, narrow the real points of disagreement, and help both sides find terms they can live with — and that a court can approve.

When the parties reach agreement, the mediator prepares a written settlement. In family matters, a properly signed mediated settlement agreement is generally binding and cannot be revoked, which gives everyone certainty once the work is done.

How the Process Works

  1. Schedule. Both parties agree to mediate and set a date. Sessions can be arranged in person or remotely.

  2. Prepare. Each side gathers the documents and priorities that matter most. If you have an attorney, they may attend.

  3. Mediate. The mediator meets with both sides — together or in separate rooms — and works through each issue toward agreement.

  4. Memorialize. Terms reached are put in writing and signed. Your attorney, or the drafting attorney, can then present the agreement to the court.

Most family mediations are completed in a single day.

Is mediation confidential? Yes. With limited exceptions provided by law, what is said in mediation stays in mediation and cannot be used against you later.

Do I need a lawyer to mediate? No. You may attend with or without an attorney. The mediator is neutral and cannot give you legal advice, so some parties choose to consult their own counsel before signing.

What if we don't reach an agreement? Nothing is lost. Anything you agree on can still be documented, and unresolved issues simply proceed as they otherwise would.

Is a mediated agreement binding? In family cases, a settlement agreement that meets the statutory requirements is generally binding and enforceable once signed.
